Copyright and trademark policy

On this page

Pressfox hosts reports that our customers create. They can contain text, photos, logos and fonts. If a report uses your work or your brand without permission, this page explains how to ask us to act. It forms part of the terms of service and the acceptable use policy.

Overview

The customer that issued a report is responsible for its content (terms, section 8). We do not review reports before they are published, but we act on valid notices. We follow the notice-and-action rules of the EU Digital Services Act (Arts. 16 and 17) and Brazil's Copyright Law (Law 9,610/1998).

Where to send a notice

  • By email to hello@pressfox.io, subject "Copyright notice".
  • By post to CARLOS A. GIRALT TORRIENTE TECNOLOGIA DA INFORMACAO LTDA (IT Solid Solutions), Avenida Prefeito Osmar Cunha, 416, Florianópolis-SC, 88015-100, Brazil.

For other problems with a report, such as illegal or harmful content that is not about your rights, use the "Abuse report" route in the acceptable use policy. We read English, Portuguese and Spanish.

What a notice must include

  1. Your name and contact details: email address, and postal address or phone number.
  2. The work or trademark you own, or represent, and where it can be seen.
  3. The report link, for example https://reports.pressfox.io/report/… or the address on the customer's own domain, and where in the report the material appears.
  4. A statement that the use is not authorised by you, your agent or the law.
  5. A statement that the notice is accurate and that you are the rights holder or authorised to act for them.
  6. Your physical or electronic signature.

Without the report link we cannot find the report. Reports are not public or searchable, and we do not browse customer content to look for it.

What happens next

  1. We acknowledge your notice and review it.
  2. If the notice is valid, we disable the hosted report page and its PDF link.
  3. We tell the workspace owner what was reported and why we acted, with a statement of reasons (DSA Art. 17).
  4. We tell you what we decided.

Disabling a hosted report does not remove copies that recipients have already downloaded.

Counter-notice

If you are the workspace owner and you believe the report was disabled by mistake, or that you have the right to use the material, you can send a counter-notice to hello@pressfox.io, subject "Copyright counter-notice". Include the same elements as a notice, with the report link, and a statement in good faith that the report was disabled by mistake or misidentification.

We forward the counter-notice to the person who sent the notice. Unless they tell us within 10 business days that they have started legal action, we may restore the report within 10 to 14 business days after receiving the counter-notice. Restoring a report is not a decision on who is right.

You can also appeal any decision we make, as described in the acceptable use policy.

Trademarks and impersonation

A brand profile, a report or a custom domain that uses another organisation's name, logo or other marks to look like that organisation breaks the acceptable use policy (documents designed to deceive). On a valid notice we may disable the report, the brand profile or the custom domain.

Repeat infringers

In appropriate cases, we close workspaces that repeatedly receive valid notices.

False notices

Knowingly false notices or counter-notices can make the sender liable for the damage they cause, including, in the United States, under 17 U.S.C. § 512(f). We may disregard notices that are abusive or clearly unfounded.
